License Agreement

This agreement only applies to scripts that have been purchased. Scripts that are offered for free by Capo Web Design Inc. are not governed by this agreement. For more details on the use of free scripts and other materials from our website, please refer to our Terms and Conditions.

Definitions

“Scripts”: These are software tools provided by Capo Web Design Inc. They may be written in PHP, Python, Node.js, or other programming languages and are designed to enhance web development projects.
“Licensee”: The individual or organization that downloads or uses Capo Web Design’s Scripts under the terms of this agreement.
“Licensor”: Capo Web Design Inc., the creator and provider of the Scripts.
“Significant Modification”: Major alterations to the Scripts that introduce distinct functionality or substantial enhancements that clearly distinguish them from the original version.
“Extended Licensing Option”: A special licensing arrangement that allows the Licensee to distribute the Scripts, either as-is or with minor modifications, to third parties.
“Download”: The process of transferring the Scripts from Capo Web Design’s website to the Licensee’s device.

This agreement (“Agreement”) is made between Capo Web Design Inc. (“Licensor”) and you (“Licensee”) upon downloading or digitally accepting any Script from Capo Web Design’s website.

1. Grant of License

The Licensor grants the Licensee a non-exclusive, non-transferable, worldwide license to use the Scripts for both personal and business purposes. The Licensee is allowed to modify the Scripts and incorporate them into projects without any limits on the number of times they can be used.

2. Ownership

All rights, titles, and ownership of the Scripts, including any related intellectual property, are retained by the Licensor. The Scripts are protected under copyright and intellectual property laws.

3. Use and Redistribution

**Personal and Business Use**: Licensees may modify the Scripts for their own personal or business-related purposes.
**Redistribution Limits**: The redistribution of unaltered or minimally modified Scripts is not permitted. Redistribution is only allowed if the Scripts have undergone significant modification.
**Significant Modification Redistribution**: Licensees may distribute significantly modified Scripts, provided each end-user has purchased a separate package.
**Extended Licensing Option**: For cases where redistribution of unmodified or slightly modified Scripts is necessary, the Licensee may negotiate an Extended Licensing Option with the Licensor.

4. Refund Policy

Refunds are not available once a package has been downloaded. Licensees are encouraged to review all available documentation, demos, or trial versions prior to making a purchase.

5. Disclaimer of Warranties and Limitation of Liability

The Scripts are provided “AS IS” without any warranties, including implied warranties of merchantability or fitness for a specific purpose. Capo Web Design Inc. disclaims all warranties and is not responsible for any damages resulting from the use of the Scripts.

6. Restrictions

Licensees are prohibited from distributing, sublicensing, or transferring the Scripts to others without prior written approval from the Licensor.

7. General Provisions

**Governing Law**: This agreement is governed by the laws of the jurisdiction where the Licensor is located.
**Entire Agreement**: This document constitutes the entire agreement between the Licensee and the Licensor.
**Amendments**: Any changes to this agreement must be documented in writing and signed by both parties.

By downloading, installing, or using the Scripts, the Licensee agrees to abide by the terms of this Agreement.
